It is contended by counsel appearing for the accused-

applicant that applicant has remained in custody for a period of more than five and a half years. It is also contended that applicant's brother Mukesh has also received injury, which is dangerous to life and the incident took place on the spur of the moment. It is further contended that disposal of appeal is bound

to take time.

No one has put in appearance on behalf of the complainant.

Learned Additional Government Advocate has opposed the application for suspension of sentence.

We have considered the contentions.

Considering the fact that applicant's brother has also sustained injuries, which is dangerous to life and deceased has sustained only a single below and applicant has already remained in custody for a period of more than five and a half years and disposal of appeal will take time, we deem it proper to allow the application for suspension of sentence.

Accordingly, the application for suspension of sentence is allowed. It is ordered that the sentence awarded to accused applicant in Sessions Case No.03/2016, C.I.S. No.72/2016 shall remain suspended if the accused-applicant furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each to the satisfaction of the learned Trial Court to the effect that he shall appear before this Court as and when called upon to do so.
