This suspension of sentence application under Section 430 B.N.S.S. has been filed by the applicants-appellants being aggrieved by the judgment of conviction and sentence dated 21.10.2024 passed by the Court of learned Additional Sessions Judge No.3, Jaipur, District Jaipur (Raj.

On consideration of the submissions made by learned counsel for the accused-applicants/appellants and also on perusal of the findings and observations given by the trial Court so also the fact that accused-applicants/appellants was on bail during trial and they did not misuse the liberty of bail and further the sentence imposed upon them has already been suspended for a period of one month under the provisions of Section 430 BNSS, this Court without expressing any opinion on the merits and demerits of the case, deems fit to suspend the sentence imposed upon the accused-applicants/appellants.

Accordingly, the application for suspension of sentence is allowed and it is ordered that the sentence awarded to accusedapplicants/appellants- Trilokchand Son of Babulal, Arving Sankhla Son of Ramdayal, Ramchandra @ Buchya Son of Pokharmal & Prahlad Son of Brijmohan in Sessions Case No. 10/2018 (123/2016) (NCV No. Session Case/77/2018) shall remain suspended on furnishing a personal bond of Rs.1,00,000/(Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial Court to the effect that they shall appear before this Court on 16.12.2024 and further on subsequent date(s) as and when called upon to do so till the disposal of the appeal on the conditions as follows:-

A. After release of the accused applicants/appellant, they shall not indulge in any criminal activity and if it is found that they are involved in any criminal activity, the order shall be recalled.

B. They will appear before the trial Court in the month of December of every year till the appeal is decided.

C. If the applicants/appellants change the place of residence, they will give in writing their changed address to the trial Court as well as the counsel in the High Court.

D. Similarly, if the sureties change their address, they will give in writing their changed address to the trial Court.
