This special appeal is directed against the order dated 28^th August, 2023 passed by the Writ Court.

In this order, the Writ Court after taking note of the submission put forth on behalf of the respondents by the learned Addl. Advocate General modified the order dated 22^nd August, 2023 by which an ad-interim order staying finalization of the selections on the post of Assistant Radiographer was passed.

The Writ Court therefore decided to modify the order dated 22^nd August, 2023 to the extent that the respondents may proceed

with the selection process and provisionally consider the candidature of the writ-petitioners in S.B. Civil Writ Petition No. 12308/2023.

Mr. N.S. Rajpurohit, the learned counsel for the appellant - State of Rajasthan draws the attention of this Court to the communication dated 07^th August, 2023 to submit that registration of the writ-petitioner, namely, Jyoti Tripathi was cancelled by the Rajasthan Para Medical Council, Jaipur and, therefore, her candidature cannot be considered for appointment to the post of Assistant Radiographer.

Even if this document vide Annexure-11 issued under the signature of the Registrar of the Rajasthan Para Medical Council, Jaipur has been brought on record of S.B. Civil Writ Petition No. 12308/2023, there should not be any difficulty for the respondents to proceed with finalization of the selection process for appointment to the post of Assistant Radiographer and to take a decision in the light of the communication dated 07^th August, 2023 from the Rajasthan Para Medical Council, Jaipur.

Accordingly, the present D.B. Spl. Appl. Writ No. 556/2024 is disposed of.
