This case is listed for orders on defects.

We, however, find that the appeal has been filed against exparte interim order by which the process of tender for procurement has been stayed.

Learned counsel for the appellant would fairly submit that the appellant has already moved an application for vacation of stay order, but the Appellate Court had to be approached as the application for vacation of stay order is still pending consideration.

We are of the view that the application for vacation of stay order filed by the appellant is required to be heard taking into consideration the fact that the issue relates to procurement which according to learned counsel for the appellant is essential for maintaining supply of electricity.

We give the appellant liberty to make mention before the learned Single Judge. If any such mention is made, we would request the learned Single Judge to hear the application for vacation of stay order at the earliest, preferably within a period of one week.

The appeal is, accordingly, disposed off.
