Appellant has preferred this special appeal against the Order dated 14.02.2024 passed by learned Single Judge whereby the writ petition has been disposed of on the ground of alternative remedy.

It is contended by counsel for the appellant that the case of the appellant is squarely covered by the decision of the Division Bench of this Court in D.B. Civil Special Appeal (Writ) No.253/2024.

The above fact is not disputed by Mr. S.S. Naruka, AAG appearing on behalf of the respondent.

Considering the fact that dispute is no longer res integra, w e deem it proper to allow the present appeal. The decision taken by the respondent to suspend registration of the appellant is declared illegal and the suspension of registration stands revoked forthwith. Respondents, however, have liberty to initiate proceedings afresh in accordance with law.

Resultantly, appeal is allowed and the order passed by the learned Single Judge is set aside. The writ petition also stands allowed.

Stay application stands disposed and pending application, if any, also stands disposed of.
