We have heard learned counsel for the appellant regarding maintainability of the instant intra court appeal on the earlier date.

Learned counsel for the appellant prays for and is granted some time for amicable settlement of the dispute between the parties.

Today, learned counsel for the appellant has submitted that the appellant is ready to pay original amount of Rs.13,13,614/- to

the respondent No.2. It is submitted that for the purpose of making said payment, the appellant may be granted time up to 31^st March, 2024. It is also submitted that the appellant is ready to deliver a post dated cheque to the respondent No.2 dated prior to 31^st March, 2024.

Learned counsel appearing for the respondent No.2 has agreed to the said proposal.

In such circumstances, this intra court is disposed of on the basis of the settlement arrived at between the parties.

The appellant shall deliver a post dated cheque to the respondent No.2 dated prior to 31^st March, 2024 within one week form today. In any case, the appellant shall make the payment of aforesaid amount prior to 31^st March, 2024.
