The present petition has been preferred with an averment that the respondent Hindustan Zinc Smelter, Debari, District Udaipur is raising new constructions for establishing new plant in the premise as possessed by them and the same is done without prior permission of the petitioner Gram Panchayat.

It has been submitted that the existing constructions of the respondent plant are already causing serious hazards to the inhabitants of the area and the new constructions would make the situation worse. The averments regarding the negative impacts of

the plant in question being run at the site and further, the impacts of the upcoming construction have been elaborately made in the petition.

However, learned counsel submits that at this stage, he would be satisfied if the petitioner Gram Panchayat is granted liberty to move appropriate representation before the Collector, Udaipur for redressal of its grievances.

In view of the submission made, the present writ petition is disposed of with a liberty to the petitioner Gram Panchayat to move a detailed representation to the Collector, Udaipur within a period of 10 days from now.

The representation when submitted, be decided sympathetically and keeping into consideration the larger public interest and in accordance with law, by the Collector within a period of 15 days thereafter.

Stay petition and all pending applications, if any, stand disposed of .
