Learned counsel for the petitioner, after arguing the matter at length, is not pressing the petition with liberty to approach the respondents with regard to the observations made by the Tribunal in the concluding para, which is quoted hereunder:

“For the reasons mentioned above, we are unable to grant the reliefs prayed by the applicant. The learned counsel for the respondents has, during the course of the arguments, informed about the case of the

applicant being considered for inter-railways transfer while waiving the condition about 5 years stay, on sympathetic considerations. We expect that a decision will be taken expeditiously in this matter. We also expect the respondents to take a decision on the period of absence from duty, in case the applicant applies before the concerned authorities, for grant of leave/regularising the same under the rules. With these observations, the OA is dismissed.”

The writ petition is dismissed as not pressed with liberty, as prayed for.

There is no doubt that the respondents shall act as per the observations made by Central Administrative Tribunal, if not already acted.

Needless to say that the petitioner shall be at liberty to avail remedy in accordance with law, if aggrieved by the decision taken.
