The petitioner has approached this Court with the grievance that the retiral dues have not been paid to him by the respondents without any valid reasons.

Learned counsel invited Court’s attention towards the facts obtaining in the present case and highlighted that even the Deputy Director (Regional), Local Self Government, Ajmer has

sent communication dated 01.03.2023 to the Executive Officer, Municipal Board, Parbatsar for payment of petitioner’s pension but nothing has been done so far.

The present writ petition is therefore, disposed of with a direction to the petitioner to file a representation along with the requisite documents and certified copy of the order instant within a period of two weeks from today.

On receiving the same, respondent No.6 shall consider and decide the same in accordance with law within a period of one month and make payment of retiral benefits including pension.

¶25

In case, the respondent No.6 is of the view that the petitioner is not entitled for pensionary benefit, he shall pass speaking order on or before 15.03.2024 under intimation to the petitioner.

It is made clear that aforesaid direction to decide the representation has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the representation in a particular manner.

Stay application is also disposed of accordingly.
