The petitioners have preferred this petition (P.I.L.) under Rule 385-A of the Rajasthan High Court Rules, 1952 and under Article 226 of the Constitution of India claiming the following reliefs:-

“It is therefore, humbly prayed that this petition in the form of Public Interest Litigation may kindly be allowed and this Hon’ble Court may be pleased to,

A/ By an appropriate writ, order or direction, the Respondent Nagar Nigam may be directed to allow the Digambar Jain temple to put a gate on Narrow passage/street with building and walls on both sides (Gali), so that Historical Heritage building of Digambar Jain temple can be protected by illegal activities and petitioners including other Jain devotees can go and worship their religion safely, hygienically and without any hindrance.

B/ By an appropriate writ, order or direction, the respondent Nagar Nigam may be directed to provide/ earmark appropriate place for basis amenities/ public toilets for local-shopkeepers and other public so that the connecting narrow passage/ street/ approach road with building and walls on both sides (approach road-Gali) which goes towards Jain temple and the religious and hygienic sanctity of the Jain temple can be protected.

C/ By an appropriate writ, order or direction, the respondent may be directed to take necessary actions to preserve the historical heritage of the area surrounding the Digambar Jain Temple.

Prayer for Interim relief:-

“On the grounds mentioned in the writ petition as well as the affidavits annexed herewith, it is most respectfully prayed on behalf of the petitioner, the Respondent may be directed to permit to post a temporary gate at said connecting narrow passage/ street/ approach road with building and walls on both sides (approach road-Gali) which goes towards Jain Temple and respondents may also be directed to provide temporary urinal facilities to local people until the pendency of writ petition.”

At the threshold itself, Mr. Rajesh Panwar, learned Senior Advocate-cum-Additional Advocate General, who has received

advance copy of the petition, submits that necessary steps shall be taken to ensure that proper hygiene and cleanliness is maintained in the approach street of the Jain Temple, which is an old shrine.

Learned Additional Advocate General further assures the Court that representation submitted by the petitioners shall be taken care of and all necessary steps shall be taken to maintain sanctity of right to worship at the temple, which includes consideration of erecting a gate at the entry point.

Upon such assurance, the instant petition (P.I.L.) is disposed of with a direction to the respondents to consider the prayers/reliefs of the petitioners, strictly in accordance with law.
