A limited prayer has been made by the learned counsel for the petitioner to decide the application filed by the petitioner before the respondents with regard to increase of the intake capacity of students from 30 to 40. Counsel submits that initially the respondents issued No Objection Certificate in favour of the

petitioner by which the intake capacity of students was allowed to the petitioner to get admission of 40 students in B.Sc. Nursing course. Counsel submits that for good reasons known to the respondents the intake capacity of 40 students was reduced by the Rajasthan Nursing Council, Jaipur vide order dated 06.08.2009. Counsel submits that the petitioner submitted an application for increasing the intake capacity of the students from 30 to 40, pursuant to the NOC dated 01.01.2008. Counsel submits that the aforesaid application submitted by the petitioner has not been decided by the respondents inspite of passing of more than three years for the reasons best known to them. Counsel submits that each time and every year the petitioner is facing difficulty and is not in a position to get 10 more students, so the respondents be directed to decide the application of the petitioner expeditiously as early as possible within a time frame. Counsel submits that the counseling process for allotment of students is ongoing, therefore the respondents be directed to decide the application of the petitioner within a period of seven days.

Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the application filed by the petitioner is pending before the authorities since 23.07.2020, instant petition stands disposed of with directions to the respondents to decide the pending application of the petitioner, if any, strictly in accordance with law after affording opportunity of hearing to all the respective parties, expeditiously as early as possible, preferably within a period of seven days from the date of receipt of certified copy of this order.
