The present writ petition has been preferred by the petitioner with a grievance that the application under Section 14 of the Securitization Reconstruction of Financial Assets & Enforcement of Security Interest Act, 2002 that was filed by the petitioner on 26.07.2023 has not been disposed of by the respondent No.1District Magistrate, Pratapgarh, Rajasthan though the statute enjoins upon him to decide the same within a period of maximum 60 days.

In this view of the matter, the present writ petition is disposed of with the direction to the petitioner to file an application for expeditious disposal of the application dated 26.07.2023 alongwith the certified copy of the order instant.
On receipt of the application, the respondent No.1 shall decide the application as early as possible preferably within 30 days of receipt of the certified copy of the order instant.
It is made clear that aforesaid direction to decide the application has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the application in a particular manner.
The stay application also stand disposed of accordingly.
