These civil writ petitions have been filed by the petitionersplaintiffs (for short ‘the plaintiffs’) against the order dated 09.04.2013 passed by the Additional District & Sessions Judge, Dausa (for short ‘the appellate court’), whereby the appellate court dismissed the appeal filed by the plaintiffs and confirmed the order dated 19.08.2011 passed by the trial court, by which the trial court dismissed the plaintiffs’ application for temporary injunction.
Having heard learned counsel for the plaintiffs and taking into consideration the facts and circumstances of the case and more particularly in view of the fact that the suit is pending consideration before the trial court since long and no stay is operating in favour of the plaintiffs till today, the trial court is directed to decide the suit, if pending with it, expeditiously, in accordance with Law.
The writ petitions stand disposed of.
Office is directed to send a copy of this order to the concerned court forthwith for necessary information and compliance.
