The instant petition has been filed by the petitioner challenging the order dated 13.12.2019 passed by the Additional District Judge No.2, Bharatpur(for short ‘the appellate court’),

[CW-3999/2020]

whereby the appellate court dismissed the appeal filed by the petitioner against the order dated 17.09.2019 passed by Senior Civil Judge No.1, Bharatpur (for short ‘the trial court’) in Civil Miscellaneous Case No.16/2018 by which the trial court dismissed the temporary injunction application filed by the petitioner.

Taking into consideration the facts and circumstances of the present case and more particularly in view of the fact that the suit was filed in the year 2018 and therefrom about 6 years have been passed, without interfering with the impugned orders, I dispose of the civil writ petition with a direction to the trial court to decide the suit, if pending with it, expeditiously, in accordance with Law.

Registry is directed to send a copy of this order to the concerned court forthwith for information and compliance.
