Both the learned counsels are ad idem that the controversy raised herein is squarely covered by judgment rendered by Division Bench of this Court at Jaipur in Gopal Kumawat Vs. The State of Rajasthan & Ors.: D.B. Civil Writ Petition No. 2963/2007, decided on 29.07.2015. However, they point out that an SLP No. 25565/2015 State of Rajasthan Vs. Gopal Kumawat arising out of the same is pending before the Apex Court.

On a Court query, both of them are agreeable that the writ petition be disposed of in view of the judgment rendered in Gopal Kumawat ibid subject to the final outcome of the pending SLP.

Disposed of accordingly in view of the joint consent.
