It is submitted by learned counsel for the petitioner that as per the erstwhile directions of this Court, the Co-operative Tribunal has been impleaded as a party respondent i.e. respondent no.5.

Learned counsel for the petitioner has limited his prayer and submitted that directions be given to the Co-operative Tribunal to decide the petitioner’s pending appeal before said Tribunal, expeditiously. In this regard, learned counsel averred that the

appeal was filed in the Year 2017, which was registered as Appeal No. 40/2017. However, since then, the same has been kept pending sans consideration. Lastly, learned counsel contended that justice delayed is justice denied and therefore, the appeal ought to be decided expeditiously.

On asking of the Court, Mr. Surya Pratap Singh, accepts notice(s) on behalf of the respondent(s). Having done so, he was unable to refute the contentions advanced by the counsel for the petitioner.

Considering the aforesaid and taking specific note of the fact that the appeal was filed in the Year 2017 and the same has not been considered by the Co-operative Tribunal till date, this Court deems it appropriate to dispose of the present petition whilst issuing directions to the respondent no.5 i.e. Co-operative Tribunal, to adjudicate upon the said appeal, registered as Appeal No. 40/2017, by way of a speaking order, within an upper time frame of 90 days, after effectuating due compliance with the principles of natural justice and also, the law applicable.

Compliance of this order, at the end of Co-operative Tribunal, be sent to the Registrar (Judicial), upon the lapse of the period of 90 days.
