By way of filing this writ petition, the petitioner is seeking direction against the respondents to remove the encroachment made on the land of facility area (park, school etc.) in Luvkush Nagar-I, Tonk Phatak, Jaipur.

It appears that before approaching this Court, the petitioner has filed a representation before the competent authority for passing appropriate orders thereon but the same has yet not been decided/adjudicated on merits and without waiting for the decision

of the competent authority on the said representation, the petitioner has approached this Court seeking above directions. 3. Since the matter is sub-judice before the competent authority, it is expected from the petitioner to approach the competent authority again for deciding the matter on merits.

With the aforesaid observation, the instant petition is disposed of granting liberty to the petitioner to approach the competent authority for redressal of his grievance.

In case, any such representation is submitted by the petitioner, the competent authority is expected to decide the same expeditiously as early as possible, strictly in accordance with law after affording due opportunity of hearing to all the affected parties after following the due process of law.

Stay application and all pending applications, if any, also stand disposed of.
