Learned counsel for the petitioner at the outset submits that the petitioner may be granted liberty to file a representation and the competent authority and the same be decided by passing appropriate administrative orders.

Request seems to be fair.

It is submitted by learned counsel for the petitioner that the issue raised in the present writ petition is squarely covered by judgment rendered by this Court in Manoj Khandelwal & Ors. v. State of Rajasthan & Ors. : S.B.C.W.P. No. 7283/2014 , decided on 16.07.2014 at Jaipur Bench and the said judgment has been followed in Krishan Lal & Ors. v. The State of Rajasthan & Ors. : S.B.C.W.P. No. 19179/2017 , decided on 30.10.2017

at Jaipur Bench, and therefore, the petitioner is also entitled to the same relief as granted in the case of Manoj Khandelwal (supra) and Krishan Lal (supra).

Given the nature of order which is being passed, no prejudice would be caused to the respondents and, therefore, the requirement of issuance of notice is dispensed with as no return is required to be filed by them.

In the aforesaid premise, the writ petition is disposed of with a liberty to the petitioner to file a fresh representation, which shall be gone into by the competent authority and appropriate administrative order shall be passed in accordance with law.

Needless to say that the competent authority shall go through the judgment relied upon by learned counsel for the petitioners as mentioned hereinabove and apply its independent mind on the applicability of the same before passing any order.

Needful be done expeditiously as possible.
