S.B. Civil Writ Petition No. 1290/2024 :-

By way of present writ petition, the petitioner has challenged the order dated 08.01.2024 issued by respondent No-4, whereby he has been placed under suspension.

Admittedly, by way of subsequent order dated 30.01.2024 the petitioner’s suspension has been revoked by the respondent – Municipal Council.

In view of the aforesaid, the present writ petition has been rendered infructuous.

Dismissed accordingly.

The stay petition also stands disposed of.

S.B. Civil Writ Petition No. 1308/2024 :-

By way of present writ petition, the petitioner has challenged the disciplinary proceedings initiated against him by memorandum of charges dated 11.01.2024 and 20.02.2024, which were issued under rule 16 & 17 of the Rajasthan Civil Services (Classification, Control & Appeal) Rules, 1958 (hereinafter referred to as “Rules of 1958”) respectively.

Learned counsel for the petitioner informed that the subsequent disciplinary proceedings initiated by memorandum of charges dated 19.01.2024 against the petitioner under rule 16 of the Rules of 1958, has been dropped by the respondent vide order dated 20.02.2024.

Having regard to the nature of the charges against him and that the matter requires factual determination and further because the charge sheet has not been challenged on the ground of jurisdiction, this Court is not inclined to interfere in this writ petition.

The writ petition stands disposed of, while directing the petitioner to file a reply to the memorandum so issued. In case the reply is submitted, the respondent – competent authority shall consider the same in accordance with law.

Stay petition also stands disposed of.
