This Public Interest Litigation has been filed seeking issuance of direction for removal of encroachment on public road, which is allegedly encroached upon by respondent No.8.

We find that number of complaints have been made to various authorities including Executive Officer, Nagar Palika, Vijay Nagar. The Executive Officer, who is in receipt of the complaint, is required to enquire into the correctness of the complaint. As the allegation is against private respondent No.8, Nagar Palika, Vijay Nagar shall issue notice to respondent No.8, hold an enquiry and then take a decision one way or the other within a period of 45 days from the date of receipt of a copy of this order.

It is made clear that this Court has not expressed any opinion on the merits of the case with regard to alleged encroachments and it is for the concerned authority to take a decision in the matter.

With the above observations, the petition stands disposed of.
