Instant writ petition has been filed under Article 227 of the Constitution of India, seeking directions for expeditious disposal of the Civil Suit No.02/2018 titled Jyoti Khanwani Vs. Rajesh pending before the Additional District Judge No.10, Jaipur Metropolitan-I.

Counsel for petitioner states that petitioner is a widow lady and has filed a civil suit for removal of unauthorized possession of defendants. In the civil suit, issues have been framed and suit

proceedings are pending at the stage of cross-examination of plaintiffs, but at this stage, defendants are delaying the proceedings. Hence, instant writ petition has been filed.

Having heard counsel for petitioner and considering the nature of suit and the stage of present civil suit, this Court is not inclined to issue any direction to decide the suit within any scheduled period, however, it is hereby observed that the trial Court shall make an endeavor to expedite the trial of the present suit. If, defendants adopt any dilatory tactics by one or another means, the trial Court may saddle the defendants with exemplary cost in order to deter the delay of proceedings. Both parties are also directed to cooperate with the trial Court to expedite the trial.

With aforesaid observations, the present writ petition stands disposed of.

A copy of this Order be sent to the concerned trial Court for compliance.
