Heard the parties.

Petitioner is wife of the sole respondent.

Petitioner has prayed for transfer of Case No.617/2022, a proceeding under Section 13 of the Hindu Marriage Act from the Family Court No.1, Bikaner to the Court of Additional District Judge, Suratgarh, District Sri Ganganagar, which is also vested with the powers of the family Court. Prayer is on the ground that there is a distance of about 200 kms. between the two places. Moreover, a criminal case is also going on between the parties at Suratgarh.

Learned counsel for the respondent opposed the prayer for

transfer.

Considering the inconvenience of the petitioner, who is a female, the prayer for transfer is allowed, however, the transferee Court at Suratgarh, District Sri Ganganagar shall ensure that the respondent is not unnecessarily harassed and if the respondent desires to appear through virtual mode, the said facility would be provided to him unless, his personal appearance before the Court is necessary.

Let the Case No.617/2022 be transferred to the Additional District Judge, Suratgarh, District Sri Ganganagar.

Accordingly, the instant transfer application stands allowed.
