The instant criminal writ petition has been filed by the petitioner praying that a direction be issued to the respondents to conduct fair, proper, impartial and expeditious investigation in case arising out of FIR No.580/2013 registered at Police Station Mahamandir, District Jodhpur.

It is emanating from the averments made in the instant writ petition that despite disclosing commission of cognizable offence no heed is being paid by the Investigating Agency as till date no effective action has been taken under the influence of the accused party. Therefore, the petitioner seeks fair, impartial and expeditious investigation in this matter.

Seeking fair impartial and expeditious investigation is a fundamental right of a person, be he a complainant/victim or the accused.

In this view of the matter, the instant criminal writ petition is allowed in part. The respondent authorities are directed to ensure that the investigation is conducted fairly, impartially and expeditiously.

Looking to the fact that the impugned FIR is pending since 2013, the respondent authorities are further directed that if the Final Report under Section 173 of Cr.P.C. is not filed till now, all the needful endeavor shall be done by it to complete the investigation and file the Final Report within a period of next two months after the receipt of a copy of this order.
