This criminal revision petition is preferred against the impugned order dated 19.08.2023, whereby the application under Section 243 Cr.P.C. was dismissed.

Learned counsel for the petitioner submits that the impugned order is illegal as the learned trial court has not assigned any cogent reason before dismissing the application under Section 243 of Cr.P.C..

I have gone through the impugned order.

Learned trial court itself has categorically stated that the documents, which the accused wants to procure, are public documents and accused himself can produce the certified copies of the same. So far as involvement of the complainant in the money lending activity is concerned, the accused-petitioner is free to initiate separate proceedings.

Order of learned trial court refusing the documents to be called from the concerned court is justified as the certified copies of the said documents are always available, therefore, I do not find any infirmity in the impugned order.

Accordingly, the criminal revision petition is dismissed. However, petitioner is free to submit the application for taking certified copies of the documents on record before the trial court, if the law permits.

The trial court may pass appropriate order in accordance with law.
