dated 04.12.2021 in regular criminal case No. 671/2017 arising out of FIR number 53/2017 P.S. Renwal District Jaipur (Rural) and passed by learned Additional Chief Judicial Magistrate, Kishangarh Renwal, district Jaipur. Learned trial court has framed charge under section 420 and 120-B IPC against both the petitioners. 2. Learned senior advocate appearing on behalf of petitioner accused Rajendra Kumar submits that in FIR complainant Laxman has mentioned that he was lured to sanction old age pension and was taken to Renwal Tehsil by Ganesh after hatching a criminal conspiracy with accused Nanuram, Sitaram, and Rajendra Kumar, accused Ganesh has have executed a sale deed in his favor. He further submits that Rajendra Kumar and Nanu Ram were attesting witnesses to the instrument executed by Laxman before the public authority (Sub-Registrar). He further submits that neither Rajendra Kumar nor Nanu Ram have any financial or other interest in the property transferred by Laxman to his real brother Ganesh. He also submits that they have placed on record a copy of bank statement indicating transfer of fund in the bank account of Laxman. He also pointed out that complainant Laxman is already receiving old age pension since 2013, and there was no occasion to lure him to sanction old age pension, on date of execution of sale deed. He also referred the documents and submitted that, in order to constitute an offence of cheating under section 420 of IPC, it is necessary for the prosecution to establish that the petitioner accused Rajendra Kumar had dishonest intention from the very beginning and with this dishonest intention, the document was executed in criminal conspiracy with Ganesh.
