This criminal miscellaneous petition has been filed by the petitioners under Section 482 CrPC for quashing FIR No.71/2023 registered at Police Station Laxmangarh, District Alwar for the offence under Sections 143, 323, 341, 336, 427 IPC (Sections 307 IPC and 3/25 of Arms Act were found to have been made out during the investigation), as well as subsequent proceedings arising therefrom.
Learned counsel for the petitioners as well as learned counsel for the complainant submitted that a compromise has been arrived between the parties and they have settled their dispute. A copy of the compromise has been filed with the petition.
Learned Additional GA has opposed the arguments.
In view of above and the law laid down by the Hon’ble Apex Court in cases of Gian Singh Vs. State of Punjab (2012) 10 SCC 303 and Narinder Singh Vs. State of Punjab (2014) 6 SCC 466 , this Court deems it just and proper to quash the proceedings in FIR No.71/2023.
Resultantly, this criminal miscellaneous petition is allowed. The FIR No.71/2023 registered at Police Station Laxmangarh, District Alwar for the offence under Sections 143, 323, 341, 336, 427 IPC (Sections 307 IPC and 3/25 of Arms Act were found to have been made out during the investigation) and the entire criminal proceedings arose therefrom are hereby quashed and set aside.
