Heard learned counsel for the parties and perused the FIR impugned as well as the other material as made available to this Court.

A bare perusal of the FIR (No.38/2016 registered at Police Station Dechu, District Jodhpur) revealing that owing to some inimical relationship, the accused persons went to the house of the victim, where, he was abused by indicating his caste. It was alleged that the accused persons were having sticks with them. It was also alleged that due to intervention of some neighbors, the victim could be rescued. The case is pending before this Court since the year 2016. Vide order dated 16.03.2016, the co-ordinate

Bench of this Court had directed to not to arrest the petitioners in connection with the above mentioned FIR.

Learned Public Prosecutor submits that after investigation, the offence has been found proved against the petitioners. In this view of the matter and taking into account the fact that the interim order is operational since 16.03.2016, this Court deems it appropriate to decide the misc. petition with the directions to the petitioners to appear before the learned trial Court on or before 16.02.2024 and to move a regular bail application.

In the event, the petitioners appear and move a regular bail application, they shall be released on bail on the very same day on the amount of surety and bond as the learned trial Judge deems fit, since no IPC offence has been invoked and there are allegations of hurling abuses only.

Till then, the petitioners shall not be arrested.

Accordingly, the instant misc. petition as well as the stay petition are disposed of.
