After arguing to some extent learned counsel for the petitioner seeks withdrawal of the instant criminal misc. petition with liberty to raise the grounds before the trial Court at appropriate stage.

Accordingly, the instant criminal misc. petition is disposed of as withdrawn with liberty as prayed for.

The stay petition also stands disposed of.

In the peculiar circumstances of this case, it is felt appropriate to direct the petitioner to appear before the trial Court on or before 20.03.2024 and to move a regular bail application. Upon his appearance and moving a regular bail application,

learned trial Court shall release him on bail on the very same day; on the amount of surety and bond as he deems fit.

Till 20.03.2024, the process shall not be executed. It is further directed that since the petitioner is a public servant, therefore, he may be at liberty to move an application for dispensation of his personal presence for a particular date. Upon filing of the same, it is expected from the learned Magistrate to consider the same in accordance with the legal provisions.
