Learned Public Prosecutor has produced the factual report dated 25.05.2023 for the perusal of this Court.
From the perusal of the factual report, this Court finds that police after making a thorough investigation in the matter, has not found the charges to be proved against the petitioners No.3 to 8. The offence under Section 498-A IPC have been found to be made out against the petitioners No. 1 and 2 only.
Heard.
Learned counsel for the petitioner does not press this criminal misc. petition but seeks liberty that the petitioner may be permitted to surrender before the trial court and file an application for bail.
Accordingly, the instant misc. petition is dismissed as not pressed. The petitioner is directed to surrender before the trial court on or before 03.06.2024 and file an application for bail. It is expected from the trial Court that the bail application will be decided as expeditiously as possible.
Till 03.06.2024, the petitioner shall not be arrested in connection with FIR No.200/2022 registered at Police Station Osian, Dist. Jodhpur, for the offences under Sections 143, 323, 406 and 498-A of IPC.
