After arguing for some time, Mr. Rajesh Choudhary, learned counsel for the petitioners seeks permission to withdraw the present petitions filed under Section 482 of the Code of Criminal Procedure, however, with a liberty to file a revision petition under Section 397 of the Code Of Criminal Procedure before the learned Sessions Judge.

With the liberty as prayed, these criminal misc. petition are dismissed as withdrawn.

In case, the revision petition is preferred before the revisional Court within a period of 30 days from today, alongwith an application under Section 5 & 14 of the Limitation Act, 1963, the revisional Court shall decide the same in accordance with law, having due regard to the fact of pendency of present petition before this Court and Section 14 of the Limitation Act, 1963.
