Petitioner has filed instant criminal miscellaneous petition for seeking expedite disposal of Criminal Case No.75/2019 titled Arjundas Vs. Vinit Shrimal for offence u/s 138 of the Negotiable Instrument Act, pending before the Additional Judicial Magistrate, Sawai Madhopur.

On the basis of material placed on record, counsel for petitioner submits that petitioner is a senior citizen and after read over the charge for offence u/s 138 of the N.I. Act against respondent-accused, the criminal trial has not progressed. It is mainly on account of non appearance of the accused. It has been submitted that the expeditious and speedy criminal trial is a fundamental right, being part of Article 21 of the Constitution of India.

Having perused the material available on record, this Court deems it just and proper to observe that the trial Curt shall take necessary steps to expedite the criminal trial of the present case and conclude the same as early as possible. It is made clear that no casual and unwarranted adjournments neither the petitioner nor to respondent-accused shall be granted without any just and reasonable cause. It is expected from both parties to cooperate with the criminal trial.

With aforesaid observations, instant criminal miscellaneous petition stands disposed of.
