The present criminal miscellaneous petition under Section 482 of CrPC has been preferred by the petitioner-husband against the order dated 06.06.2018 passed by the learned Additional Chief Judicial Magistrate, Shahpura, District Bhilwara (hereinafter referred to as ‘the learned trial Court’) in Criminal Case No. 221/2017, whereby the learned trial Court directed the petitioner to pay a sum of Rs. 5,000/- per month as interim maintenance to the respondent-wife.

Nobody appeared on behalf of the petitioner.

Perused the material available on record.

Having regard to the facts and circumstances of the case and in view of the fact that the main application under Section 125 of CrPC is pending consideration before the learned trial Court,

therefore, this Court deems it appropriate to dispose of the present criminal miscellaneous petition with direction to the learned trial Court to decide the main application under Section 125 of CrPC within a period of three months from the date of receipt of the certified copy of the order instant.

The stay application also stands disposed of accordingly.
