Learned counsel for the petitioner is not assailing the order dated 01.03.2007 as well as the order dated 02.08.2023 passed by the Additional Chief Judicial Magistrate No.3, Jaipur City and Additional District and Sessions Judge No.6, Jaipur Metropolitan-II respectively on its merits. He has confined his prayer for conversion of arrest warrants issued against the petitioner into bailable warrants. Counsel submits that an FIR No.403/2003 was registered against the petitioner and co-accused persons with Police Station Vidhayakpuri, Jaipur which resulted in final report negative, thereafter a protest petition was filed before the Court of Chief Judicial Magistrate, Jaipur City wherein a cognizance was taken against the present petitioner as well as the co-accused persons vide order dated 01.03.2007 under Sections 120-B, 193, 211, 150, 452, 327, 386, 364 and 364(A) IPC. Counsel submits that straightaway arrest warrants were issued against the petitioner and co-accused persons. Counsel submits that the

petitioner was not aware about the aforesaid order as he is residing at Delhi.

Counsel submits that in the meantime, the co-accused persons, namely, Kapil Modi and Nischal K Punj have been discharged by the Court of Additional District and Sessions Judge No.15, Jaipur, Metropolitan Jaipur vide order dated 25.01.2017. Counsel submits that now the petitioner came to know about the arrest warrants issued against him.

Counsel submits that the petitioner is ready and willing to appear before the trial Court for availing his appropriate legal remedy, but looking to his age, i.e., 59 years, the arrest warrants issued against the petitioner be converted into bailable warrants. 4. Per contra, learned Public Prosecutor opposed the prayer. 5. Heard and considered the submissions made at Bar and perused the material available on the record. 6. In a criminal misc. petition filed by the co-accused in the same case, the Co-ordinate Bench of this Court vide its order dated 29.11.2024 has converted non-bailable warrant into bailable warrant. 7. Considering the arguments put forward by learned counsel for the petitioner and looking to the limited prayer made by counsel for the petitioner with regard to conversion of arrest warrants into bailable warrants, the instant criminal misc. petition stands disposed of granting liberty to the petitioner to appear before the trial Court within a period of 15 days from today. In case, the petitioner appears before the trial Court within the above stipulated time, he be released on bail, after furnishing personal bond and surety bonds to the satisfaction of the trial Court.
