The instant Misc Petition has been preferred on behalf of the petitioner who is the complainant-victim of the FIR No.196/2023 registered at the Police Station Banera, District Shahpura for the offences 143, 341, 323, 447, 354, 452, 394 & 427 of the IPC. He seeks interference of this Court for issuance of appropriate direction to the authorities for conducting fair, impartial and expeditious investigation.

Heard learned counsel for the petitioner as well as the learned Public Prosecutor for the State. Perused the FIR impugned.

I have gone through the documents as made available to the Court. Prima facie, it is appearing that an assault was made upon the family of the victim and they were clobbered brutally. The coloured photographs and the medical reports revealing several injuries and stitched wounds of the victims. It is further revealing that a case is proved against the accused persons for their

involvement in commission of the crime. The FIR got lodged on 08.10.2023 and till today all the culprits have not been booked. 4. Considering the overall facts and circumstances of the case and the submissions made at bar and after perusing the material available on record, this Court feels it appropriate to direct the Superintendent of Police, Shahpura to look into the matter personally and issue necessary instructions to the investigating officer so that the guilty may be booked. The entire evidence collected during investigation, be taken on the record of the case diary including the medical treatment record, discharge ticket, coloured photographs etc. whereafter, a report under Section 173 of the Cr.P.C. shall be submitted before the concerned Magistrate and the accused be arrested at the earliest without unnecessary delay.

In view of the above, the instant Misc. Petition as well as stay petition stand disposed of.
