Petitioner has filed this anticipatory bail application under Section 482 B.N.S.S., in connection with F.I.R. No.206/2024, registered with the Police Station chhipabarod, District Baran for the offences under Sections 341, 323, 379, 307 & 34 of IPC.

Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter and during the investigation, the police has not found the allegation proved against him for the offence under Section 379 of IPC. Counsel further submits that the injuries sustained by the complainant- party are simple in nature and in such circumstances no purpose would be served in sending the accused- petitioner in custody, therefore, he may be extended benefit of anticipatory bail.

Learned Public Prosecutor has vehemently opposed the anticipatory bail application and submits that two other criminal

cases are pending against the accused- petitioner, therefore, he does not deserve indulgence of bail by this Court.

Considered the submissions made by counsel for the petitioner as well as the learned Public Prosecutor and perused the material available on record.

Having regard the submissions made by counsel for the petitioner and so also the fact that the injuries sustained by the complainant- party are simple in nature and no offence under Section 379 is found to be proved by the Investigating Agency so far, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to extend the benefit of anticipatory bail to the petitioner.

The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Chhipabarod, District Baran in F.I.R. No. 206/2024 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-

(I). that the petitioner shall make himself available for interrogation by a police officer as and when required;

¶24

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and

(iii). that the petitioner shall not leave India without previous
