The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners Rajendra Kumar, Ashok Kumar, Ramhans and Satayprakash. The petitioners have been arrested in connection with FIR No.38/2023 registered at Special Police Station SOG, District Jaipur Metropolitan for the offence(s) under Sections 419, 420, 467, 468 & 120B IPC and Sections 3 & 10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

Learned counsel for the accused-petitioners submits that a false case has been foisted against the petitioners. The accusedpetitioners have nothing to do with the alleged offences. The offences alleged against the accused-petitioners is triable by Magistrate. Accused -petitioners are in custody since the date of their arrest. Trial is likely to take long time to conclude. No fruitful purpose would be served by keeping the accused-petitioners behind the bars till disposal of the case. Therefore, bail applications of the accused-petitioners may be allowed.

Per contra, learned Public Prosecutor vehemently opposes the bail applications. 4. Considering the arguments advanced by the counsel for the parties and looking to the overall facts and circumstances of the case, more particularly the fact that offences alleged against the accused-petitioners are triable by Magistrate, therefore without commenting anything on the merits/demerits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners Rajendra Kumar S/o Shri Amraram, Ashok Kumar S/o Mangilal, Ramhans S/o Shri Giriraj Prasad Meena and Satayprakash S/o Shri Ramkesh Meena in connection with FIR No.38/2023 registered at Special Police Station SOG, District Jaipur Metropolitan shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
