The present bail application under Section 439 of the Code of Criminal Procedure has been filed by the applicant, who is in custody in connection with the FIR No.424/2023 registered at Police Station Sanchore, District Jalore for the offences punishable under Sections 302, 120-B and 212 of the Indian Penal Code.

Learned counsel further submitted that allegation against the present applicant is that of conducting recce.

He argued that similarly situated co-accused namely, Kamlesh Kumar (S.B. Criminal Misc. Bail Application No.5437/2024) and Tag Singh (S.B. Criminal Misc. Bail Application No.2903/2024) against whom the allegation of recce were levelled have been enlarged on bail by this Court vide orders dated 10.05.2024 and 24.04.2024.

Learned Public Prosecutor and Mr. Jain, learned senior counsel appearing for the complainant have vehemently opposed the bail application but however, not in a position to distinguish the case of the applicant from that of Kamlesh Kumar and Tag Singh.

Heard learned counsel for the parties and perused the material available on record.

Following the reasoning given in the case of Kamlesh Kumar and Tag Singh, the present bail application is also allowed. 6. Consequently, the present bail application filed under Section 439 of the Code of Criminal Procedure is allowed. It is ordered that the applicant – Vikas @ Vikki S/o Ganpat Lal arrested in connection with FIR No.424/2023 registered at Police Station Sanchore, District Jalore shall be released on bail; provided that he executes a personal bond in the sum of ₹50,000/- and two sureties of ₹25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.

Needless to mention that the above observations made by this Court are on the basis of material so far produced before the Court. These are only prima-facie observations and the same shall however, not come in the way of the trial Court to take independent view of the matter, based on ocular and oral evidence, while finally deciding the case.
