The 3^rd bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.225/2022 Registered at Police Station Shahjahapur, District Police Bhiwadi, District Alwar for the offence(s) under Sections 143, 365, 506 and 447 IPC (later on offence under Sections 147, 148, 149, 302, 364, 448 and 201 IPC was found to have been made out).

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since long. First bail application filed by the petitioner was dismissed by this Court vide order dated 10.02.2023. After that, second bail application filed by the petitioner was dismissed as withdrawn vide order dated 10.10.2023 with liberty to file fresh bail application after recording the statement of witnesses namely Amit and Naveen. Learned counsel for the petitioner also submits

that Similarly situated co-accused Hariom @ Baba, Yogesh @ Yogi and Sachin @ Ravan have been enlarged on bail by the Co-ordinate Bench of this Court. Learned counsel for the petitioner also submits that no identification parade of the petitioner was conducted. Complainant Suman Devi had not levelled the allegation against the petitioner. Statement of Amit and Naveen have been recorded by the trial court. PW3-Naveen in his crossexamination admitted that neither he saw abduction of his father nor he saw as to who killed him. PW4-Amit Kumar had not seen the incident. Conclusion of trial may take long time. Hence, the petitioner may be enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the complainant have opposed the 3^rd bail application.

Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the 3^rd bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Hakikat @ Dk S/o Lalsingh be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he will appear before the trial court on all subsequent dates of hearing and as and when called upon to do so.
