Matter has come up on two applications bearing Inward No.1/2024 & 2/2024 filed by the petitioners seeking withdrawal of the names of the petitioner Nos.3 & 4, namely Nirmal Dudi & Jyoti Solanki, as they were arrested on 04.07.2024, challan was filed on 26.07.2024 & they were enlarged on bail vide orders dt.11.07.2024 & dt.05.07.2024 passed by the Courts below.

For the reasons & grounds mentioned therein, both the applications are allowed . The names of petitioner Nos.3 & 4, namely Nirmal Dugi & Jyoti Solanki are, hereby, deleted from the array of the petitioners.

Consequently, the 4^th bail application filed on behalf of the petitioner Nos.3 & 4 is disposed of as withdrawn.

Another application bearing Inward No.3/2024 has also been filed by petitioners praying therein for taking amended bail application on record, as the names of petitioners No.3 & 4, namely Nirmal Dudi & Jyoti Solanki in the original bail application, who have already been granted bail by ld. Courts below after being arrested, have been deleted in the amended bail application.

For the reasons & grounds mentioned therein, the application is allowed . The amended bail application is taken on record.

Learned counsel appearing for the petitioners No.1 & 2, namely Amit Agrawal & Pratibha Kamal submits that the investigation in the case has been completed, notice under Section 41-A of Cr.P.C. for appearance before the trial Court for presentation of challan, has been served upon the petitioners and charge-sheet would be filed on 03.08.2024.

Looking to the overall facts & circumstances, learned counsel appearing for the petitioners No.1 & 2, submits that he may be permitted to withdraw the present 4^th bail application.

Permission, as sought for, is granted.

Accordingly, the instant 4^th bail application is dismissed as

withdrawn.

Pending application(s), if any, also stands disposed of.

However, if the petitioners No.1 & 2, namely Amit Agrawal & pratibha Kamal appear before learned Trial Court, in compliance of notice under Section 41-A of Cr.P.C. for presentation of challan and prefer bail application(s), the learned Trial Court is expected to hear & decide the same preferably on the very same day in accordance with law.
