The instant bail application has been filed under Section 439 of Cr.P.C. on behalf of the petitioners, who have been arrested in connection with FIR No.228/2023 registered at Police Station Mantown, District Sawai Madhopur for the offences under Sections 143, 323 & 341 of IPC. During the course of investigation, offences under Section 325 & 307 of IPC have also been added.

Learned counsel for the petitioners wants to withdraw this bail application to the extent of petitioner No.1 – Manbhar Devi with liberty to file fresh bail application after filing of charge-sheet.

Accordingly, the present bail application is dismissed as withdrawn to the extent of petitioner No.1 – Manbhar Devi with liberty, as prayed for.

So far as, the petitioner No.-2 - Roshani is concerned, it is contended by learned counsel for the petitioner that the accusedpetitioner has falsely been implicated in this case. She further submits that specific allegation of causing life threatening injury is against Manbhar Devi. She submits that petitioner is a young girl aged about 19 years. There are no criminal antecedents of the petitioner. The petitioner are in custody since 19.12.2023 and trial of the case will take considerable time. She also contends that further custody of the petitioner would not serve any fruitful purpose.

Learned Public Prosecutor opposes the bail application and submits that petitioner is named in the FIR.

I have considered the contentions.

Having regard to the totality of the facts and circumstances

of the case; considering the arguments advanced by learned counsel for the petitioner, especially the fact that specific allegation of causing life threatening injury is against Manbhar Devi, there are no criminal antecedents of the petitioner and looking to the custody period of the petitioner, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application.

This bail application is accordingly allowed and it is directed that accused-petitioner - Roshani D/o Kaluram shall be released on bail provided she furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the

stipulation that she shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
