The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.236/2023 registered at Police Station Bhusawar, District Bharatpur for the offence(s) under Sections 143, 323, 341 & 365 of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the offence under Section 325 is not made out. There is no dangerous to life injury sustained to injured Dalveer Singh. The injuries sustained to injured Dalveer Singh on the right and left leg were found to be grievous in nature. The case does not travel beyond Section 325 of IPC. The offences under Sections 323, 341 & 325 of the IPC are bailable one. The petitioner is in

custody since long and trial/investigation of the case may take considerable time, therefore, the bail application may be allowed.

Learned Public Prosecutor as well as learned counsel for the complainant vehemently oppose the bail application.

Heard and perused the material available on record.

Considering the fact that there is no injury at the vital part of the injured Dalveer Singh and injuries are not opined to be dangerous to life, thus, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Gyanchand S/o Bhuri Singh in connection with FIR No.236/2023 registered at Police Station Bhusawar, District Bharatpur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
