The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The accusedpetitioners have been arrested in connection with FIR No.138/2020 registered at Police Station Malarana Dungar, District Sawai Madhopur for the offences under Sections 420, 467, 468, 471 & 120-B of IPC. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the offences are exclusively triable by Magistrate and the matters pertain to year 2020. The accusedpetitioners are in custody since long and the trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.

Learned Public Prosecutor vehemently opposes the bail applications.

Heard and perused the material available on record.

Considering the fact that the offences are exclusively triable by Magistrate, thus, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accusedpetitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners namely 1. Manraj @ Poplya S/o Kalu Ram 2. Ramkesh S/o Heeralal 3. Ramlakhan S/o Kanhaiyalal 4. Ramesh Chand S/o Panchulal & 5. Mahendra Singh S/o Ramkunwar in connection with FIR No.138/2020 registered at Police Station Malarana Dungar, District Sawai Madhopur, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
