This bail application has been filed u/S 438 Cr.P.C. by the petitioners in connection with FIR No. 265/2023 registered at Police Station Dablana, District Bundi for offence under Section 341, 323, 143 IPC.

Learned counsel for the petitioners seeks to withdraw the bail application on behalf of petitioner-applicant No. 1-Mukhtar Ahmad, petitioner-applicant No. 3-Fakhruddin & petitionerapplicant No. 4-Ajad. Accordingly, bail application of petitioner-

applicant No. 1-Mukhtar Ahmad, petitioner-applicant No. 3- Fakhruddin & petitioner-applicant No.-4 Ajad is dismissed as withdrawn.

Learned counsel for the petitioner submits that the accused petitioner No. 2-Jubunisha has been falsely implicated in this case and there is no specific overt act assigned to the petitioner and the petitioner is an old woman, therefore anticipatory bail may be granted to her.

Learned Public Prosecutor vehemently opposed the bail application.

Taking into consideration the allegations and so also the fact that the petitioner is a woman of age about 58 years, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to allow the anticipatory bail of petitioner No. 2 namely; Jubunisha.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C., qua the petitioner No. 2 namely; Jubunisha is allowed and it is ordered that in the event of arrest of the petitioner Jubunisha in connection with FIR No.265/2023 registered at Police Station Dablana, District Bundi shall be released on bail, provided she furnishes a personal bond in the sum of Rs.1,00,000/(Rupees One Lac Only) with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make her available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
