The instant application for interim bail has been preferred by the applicant, as his father – Bheraram has passed away on 09.05.2024, while enclosing a copy of the death certificate of said Bheraram.

Learned counsel for the applicant prayed that the applicant be granted 15 days’ interim bail for performing last rites in wake of the death of his father and to meet and console his family members.

Learned Public Prosecutor opposed the present interim bail application by contending that already more than 10 days’ time has since passed and whatever rites and rituals were to take place, must have already taken place.

Heard learned counsel for the parties and perused the record.

True it is that more than 10 days’ time has since passed but still there may be many rituals which the applicant (only son of the deceased) has to perform. He has to meet the family members as well as to console them.

Hence, adopting humanitarian consideration, the present application is allowed. The applicant – Bhakhar Ram S/o Late Bheraram is granted 7 days’ interim bail. The applicant shall be released on 5:00 p.m. on 22.05.2024 and he shall have to surrender back before the concerned jail authorities on 30.05.2024 at 10:30 a.m., positively.

Applicant shall furnish a personal bond of ₹50,000/- and two sureties of ₹25,000/- each to the satisfaction of Jail Authority concerned. The Jail Authority shall not insist upon the solvency certificate issued by the Tehsildar/competent authority. He shall however be free to ascertain himself the solvency of the applicant as per his own accord.

The interim bail application is accordingly disposed of.
