The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 71/2024 registered at Police Station Behror, District Kotputli, Behror for the offence(s) under Sections 419, 420, 406 and 120-B of IPC and Sections 43, 66-C and 66-D of I.T. Act and Section 3, 7 and 10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

Learned counsel for the petitioners submits that the accusedpetitioner have falsely been implicated in these cases. The accused petitioners are in custody since their arrest and the trial of the case will take sufficiently long time. There is no criminal antecedents against the petitioners, therefore, the benefit of bail may be granted to the accused-petitioners.

Learned Public Prosecutor opposes the bail applications and submits that petitioners were caught red handedly for facilitating the examinees through whats-app and computer, therefore considering the gravity of the offence, their bail application may be dismissed.

Considering the facts that petitioners are in custody since long and charge-sheet has already been submitted, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners Mahesh Kumar S/o Sh. Ajit Singh, Amit Kumar S/o Mangeram, Ravi Yadav S/o Shri Kaptan Singh and Sandeep Kumar S/o Late Shri Ashok Kumar in connection with FIR No. 71/2024 registered at Police Station Behror, District Kotputli, Behror shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
