The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 19/2024 registered at Police Station Moti Dungari, District Jaipur City East for the offence(s) under Sections 143, 341, 323, 327 and 427 of IPC.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. Learned counsel further submits that petitioner and injured have entered into compromise and the fact of compromise has been recorded by the learned trial court in the rejection order. Matter is exclusively triable by Magistrate and trial of the case may take considerable time. Charge-sheet against the petitioner has already been

submitted before the trial court and petitioner is in custody since 18.02.2024, therefore, the benefit of bail may be granted to the accused-petitioner.

Learned Public Prosecutor opposed the bail application.

Learned counsel appearing on behalf of the complainant supports the factum of compromise and the compromise has been placed before the trial court. Learned counsel further submits that if the petitioner is enlarged on bail then complainant has no objection.

Heard and perused the charge-sheet.

Considering the fact of compromise placed before the trial court and the fact that the matter is exclusively triable by Magistrate, without commenting anything on the merit of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Mohammad Bilal @ Shadab S/o Mohammad Latif, in connection with FIR No. 19/2024 registered at Police Station Moti Dungari, District Jaipur City East shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
