The instant application for bail has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in relation to F.I.R. No.17/2021 registered at Police Station Rawatsar, District Hanumangarh for the offences under Sections 363, 366, 376 IPC and Section 3/4 of POCSO Act.

The matter pertains to bail jump.

Learned counsel for the petitioner submits that the petitioner was granted regular bail vide order dated 04.05.2021 in S.B. Criminal Misc. Bail Application No.5255/2021 and is facing trial before the learned court below in connection with the offences in question; however, during the course of the trial, the petitioner jumped the bail on 12.06.2023 while remaining absent in the

court and his bail bonds were forfeited. Learned counsel also submits that in pursuance of the warrant of arrest issued against the petitioner, he was arrested on 04.03.2024 and since then, he is in judicial custody.

3.1 Learned counsel further submits that the petitioner’s mother was seriously ailing, therefore, he could not appear in time before the learned trial court.

Learned Public Prosecutor opposes the bail application.

Heard. Perused the material available on record.

¶23

Having regard to the entirety of facts and circumstances of the case as available on record and looking to the fact that the trial of the case is likely to take a long time and without expressing any opinion on the merits of the case, this Court is of the opinion that the petitioner deserves to be enlarged on bail.

Consequently, the bail application is allowed. It is ordered that the accused-petitioner namely Karni Singh @ Kalu Ram S/o Ram Singh in relation to the F.I.R. No.17/2021 registered at Police Station Rawatsar, District Hanumangarh, shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing as and when called upon to do so.

However, while granting the last opportunity to the petitioner, it is made clear that if he commits any default in

appearing before the learned trial court on the date fixed and jumps the bail, no leniency would be extended to him in future.
