The present bail applications have been filed under Section 439 Cr.P.C. on behalf of the petitioners who are in custody in connection with FIR No. 59/2023, Police Station - Sameja Kothi, District - Sri Ganganagar for the offences under Sections 8/21, 25 and 29 of NDPS Act.

Heard learned counsel for the parties. Perused the material available on record.

Learned counsel for the petitioners submitted that as per the prosecution story, 270 grams of smack (Chitta) was recovered from a plastic polythene bag. It is further submitted that if the weight of plastic polythene bag is excluded from the total weight, there is all possibility that the total weight of the contraband is marginally excessive to the commercial quantity. However, in identical matters, this Court has granted benefit of bail. Learned counsel has produced copy of the orders dated 29.05.2023, 23.05.2023 and 22.03.2023 passed in identical bail applications to buttress his arguments. The accused-petitioners is behind bars since 06.04.2023 and the trial of the case will take long time. Therefore, it is prayed that the accused-petitioners may be enlarged on bail.

Learned Public Prosecutor has vehemently opposed the prayer made by the petitioners. 5) Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C. 6) Accordingly, the bail applications filed under Section 439 Cr.P.C. are allowed and it is directed that petitioners - (1) Gurvinder Singh @ Guri S/o Shri Buta Singh (2) Rajpreet Singh @ Raju S/o Shri Buta Singh (3) Mangi Lal S/o Shri Sat Pal shall be released on bail in connection with FIR No. 59/2023, Police Station - Sameja Kothi, District - Sri Ganganagar provided they execute a personal bond in a sum of Rs.1,00,000/-

each with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
