This application for anticipatory bail has been filed by the accused-petitioner against the order dated 13.02.2024 passed by learned Additional Sessions Judge No.1, Sikar, Rajasthan under Section 438 of Cr.P.C. apprehending his arrest in connection with FIR No.35/2024, registered at Police Station Dadiya, District Sikar for the offences under Sections 420, 406 and 120-B of IPC.

Learned counsel for the accused-petitioner submitted that the accused-petitioner has falsely been implicated in this case. Learned counsel further submitted that the FIR lodged against the petitioner is for the offences under Section 420, 406 and 120-B of IPC, which are triable by Magistrate, there is no necessity of custodial interrogation and there is no other criminal case pending against the petitioner. He further submits that the allegation against the petitioner has been levelled to the effect that the accused-petitioner induced the complainant to give him money for

arranging the marriage of complainant and Hem Singh. As per the police report, marriage of complainant and Hem Singh have been solemnized, therefore, the accused-petitioner be granted benefit of anticipatory bail.

Learned Public Prosecutor opposed the bail application and submitted that the petitioner should not be granted benefit of bail. 4. Heard learned counsel for the parties and perused the case diary.

Looking to the facts and circumstances of the case and the fact that the offences made against accused person are triable by Judicial Magistrate, but without expressing any opinion on the merits/demerits of the case, this Court deems it fit to grant anticipatory bail to the accused-petitioner.

Accordingly, the bail application under Section 438 of Cr.P.C. is allowed and it is directed that in the event of arrest of accusedpetitioner Rajveer Singh Tanwar S/o Shri Sugan Singh in connection with FIR No.35/2024, registered at Police Station Dadiya, District Sikar, the accused-petitioner shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/SHO on the following conditions:-

(1) that the accused-petitioner shall make himself available for interrogation before a police officer as and when required;

(2) that the accused-petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; and

(3) that the accused-petitioner shall not leave India without previous permission of the Court.
