Instant III application for bail has been filed by petitioner under Section 439 Cr.P.C. in connection with FIR No.304/2023 registered at Police Station Tapukda, District Alwar for offences under Sections 323, 341, 324, 308, 427 & 34 of IPC.

Counsel for petitioner submits that injuries to the injured Rahisen and Suman Khan have been opined to be simple in nature. There are no criminal antecedents against the petitioner. After investigation, charge-sheet has been filed, petitioner is in custody since 16.10.2023, and he is not required for the purpose of investigation, the conclusion of trial may take a considerable time, therefore, petitioner be released on bail.

Having heard counsel for petitioner, counsel for complainant as well as learned public prosecutor and perused the material available on record, considering the contention of counsel for petitioner as noted hereinabove so also the nature of injury and the fact that petitioner is in custody since 16.10.2023, chargesheet has been filed, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the third bail application is allowed and it is ordered that the accused-petitioner Rahees S/o Hakmuddin shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
